Non-Refundable Policy

1. Purpose and Scope

This Non-Refundable Policy (“Policy”) sets forth and governs the terms, conditions, limitations, and exclusions applicable to any and all payments, fees, costs, and monetary consideration of any nature whatsoever (collectively referred to as “Fees”) tendered, remitted, or otherwise provided by any individual or entity (“Subscriber,” “User,” or “You”) to NGO King (“Company,” “We,” or “Our”) for the Software and related services.

2. Acceptance

By using our Software in any manner, You acknowledge and agree to the terms and conditions of this Policy, including its binding nature, limitations, and exclusions.

3. Non-Refundable Fees

• 3.1 Subscription Fees: Non-refundable for any reason including non-use, dissatisfaction, or business changes.
• 3.2 Implementation and Setup Fees: Non-refundable once work has commenced.
• 3.3 Maintenance and Support Fees: Fully non-refundable.
• 3.4 Third-Party Fees: Company is not liable for refunding charges imposed by third parties.
• 3.5 Promotional Offers: All discounted or trial-related fees are final.

4. Cancellations

Cancellations take effect prospectively. No refund for unused time or prepaid amounts. Access continues until end of billing cycle.

5. Upgrades and Downgrades

All modifications are subject to new terms. No refund or credit for previously paid fees. Downgrades take effect from the next billing cycle only.

6. No Obligation to Refund

All Fees are strictly non-refundable unless explicitly required by law. The Company provides the Software on an "as-is" basis and assumes no liability for dissatisfaction, non-usage, or outages.

7. Exceptions

• 7.1 Mandatory Legal Compliance: Refunds are only issued where mandated by law.
• 7.2 Duplicate Transactions: Refundable upon verified proof of duplicate charges within 30 days.
• 7.3 No Broader Waiver: No other conditions warrant refunds.
• 7.4 Limitation of Liability: Refunds (if applicable) are limited to actual Fees received.
• 7.5 No Chargebacks Without Prior Notice: Chargebacks require prior refund attempt through Company channels.

8. Dispute Resolution

• 8.1 Notice Requirement: Disputes must be submitted within 15 calendar days with supporting documents.
• 8.2 Interim Payment: Subscriber must pay all undisputed fees while dispute is reviewed.
• 8.3 Process: Company will review and decide within 30 days.
• 8.4 Governing Law: Refer to Terms of Service or Subscription Agreement.
• 8.5 No Chargebacks Without Compliance: Chargebacks without proper procedure are a breach of this Policy.
• 8.6 Rights Reserved: Company may pursue legal action for breaches or non-payment.

9. Governing Law

This Policy shall be governed by the laws of Jaipur, Rajasthan. All legal disputes shall be subject to the jurisdiction of Rajasthan courts.

10. Modifications

The Company reserves the right to modify this Policy at any time. Updates will be published on our website or communicated by email or app notifications. Continued use implies acceptance.
